Often inventions or technical developments are being made by employees on the job. If an employee has made an invention or a development in the course of their work, the employer can claim the inventions of his employee and, for example, apply for industrial property rights in his name. The employer is thus entitled to use the invention in their business or to license it to third parties. Employee Invention Law (ArbNErfG) not only deals with questions of reporting an invention, claiming and using the invention as employer but also deals with the inventor’s claim to reasonable compensation.
